2. WHAT IS CALIFORNIA PROPOSITION 65?
California Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, is a California law intended to help consumers make informed decisions about exposure to certain chemicals.
The law requires California to maintain and update a list of chemicals known to the state to cause:
Cancer.
Birth defects.
Other reproductive harm.
Proposition 65 may require covered businesses to provide clear and reasonable warnings before knowingly and intentionally exposing California consumers to listed chemicals at levels that require a warning under the law.
These warnings can appear on product labels, packaging, websites, retail displays, and other appropriate locations.

3. WHY DO SOME DIETARY SUPPLEMENTS CARRY A PROPOSITION 65 WARNING?
Dietary supplements may contain naturally occurring or other trace substances, depending on their ingredients, sources, formulation, manufacturing processes, and packaging.
Examples of chemicals relevant to certain food and dietary supplement exposure assessments may include:
Lead and lead compounds.
Inorganic arsenic compounds.
Cadmium.
Mercury and mercury compounds.
Other chemicals identified on California’s Proposition 65 list.
Some elements occur naturally in the environment and may be present in soil, water, and agricultural ingredients.
However, the mere detection of a listed chemical does not automatically establish that a Proposition 65 warning is required.
Warning determinations depend on applicable legal standards, the chemical involved, the amount and route of exposure, and any relevant exemptions.
The presence of a naturally occurring substance also does not automatically establish a legal exemption.
4. HOW ARE PROPOSITION 65 WARNING REQUIREMENTS DETERMINED?
California establishes exposure-based standards for many Proposition 65-listed chemicals.
These standards may include:
No Significant Risk Levels (NSRLs): Exposure levels established for certain chemicals listed as causing cancer.
Maximum Allowable Dose Levels (MADLs): Exposure levels established for certain chemicals listed as causing birth defects or other reproductive harm.
The standards are established by the California Office of Environmental Health Hazard Assessment (OEHHA).
A product’s warning determination may involve reviewing the chemical, its applicable safe harbor level, the expected exposure from normal or reasonably anticipated use, and other relevant circumstances.
Chemical concentration and consumer exposure are not necessarily equivalent.
Where applicable, qualified scientific or regulatory assessments may be used to determine whether a warning is required.

A Certificate of Analysis or general heavy-metal test does not, by itself, establish whether a product requires a Proposition 65 warning. An appropriate exposure assessment may also be necessary.
Product-specific certifications, testing claims, and manufacturing representations apply only where supported by applicable documentation.
6. UNDERSTANDING PROPOSITION 65 WARNINGS
A Proposition 65 warning communicates information concerning potential exposure to one or more chemicals listed by California as causing cancer, birth defects, or other reproductive harm.
A Proposition 65 warning does not automatically mean that a product violates federal safety standards or that the product is unsafe.
Similarly, the absence of a Proposition 65 warning does not constitute a guarantee that a product is free from every listed chemical or other potential risk.
Proposition 65 warning requirements are separate from federal dietary supplement regulations.
Customers should review product labels, ingredients, warnings, and recommended usage instructions before consuming dietary supplements.
Individuals with specific medical concerns should consult a qualified healthcare professional.
7. PROPOSITION 65 WARNINGS ON OUR WEBSITE
MNM ProLabs provides product information through its official online store at www.mnmprolabs.com.
When a product requires a California Proposition 65 warning and the applicable legal requirements apply to the sale, the required warning will be communicated in an appropriate manner before purchase.
Depending on the circumstances, this may include:
A warning displayed on the individual product page.
A clearly identified product-specific warning link.
A warning presented before checkout is completed.
Appropriate labeling or information accompanying the physical product.
Warnings will be associated with the applicable product rather than indiscriminately applied to all MNM ProLabs products.
For eligible California sales, warnings will be presented in accordance with applicable California requirements.
8. UPDATED CALIFORNIA WARNING REQUIREMENTS
California updated its regulations governing certain short-form Proposition 65 warnings, with amendments effective January 1, 2025.
Under the updated requirements, applicable new short-form safe harbor warnings identify relevant listed chemicals associated with the warning.
Transition provisions permit qualifying products manufactured and labeled before January 1, 2028, to continue using certain previous short-form warning formats.
MNM ProLabs will review applicable warning language and delivery requirements when determining whether a product-specific warning is required.
Warning language may vary depending on whether the exposure relates to cancer, reproductive harm, or both, as well as the type of product and exposure.
9. PROPOSITION 65 AND IN-PERSON EVENT SALES
MNM ProLabs may sell dietary supplements, health and wellness products, apparel, and merchandise at fitness expos, bodybuilding competitions, sporting events, trade shows, and other authorized promotional locations.
When applicable Proposition 65 requirements apply to a product sold at an event in California, required warnings may be provided through compliant product labeling, packaging, point-of-sale disclosures, or other legally acceptable methods.
Product demonstrations, sampling activities, and promotional events will be evaluated for any applicable exposure-warning obligations.
10. DOES PROPOSITION 65 APPLY OUTSIDE CALIFORNIA?
Proposition 65 is a California law addressing exposures within California.
MNM ProLabs serves customers throughout the United States and internationally, but Proposition 65 does not automatically require the same warning for an exposure occurring outside California.
Other jurisdictions may have separate product safety, labeling, chemical disclosure, and consumer protection requirements.

Does a Proposition 65 warning mean the product is dangerous?

Does every dietary supplement require a Proposition 65 warning?

Do naturally occurring minerals automatically require warnings?
No. The relevant exposure must be evaluated under applicable Proposition 65 standards. Certain narrowly defined naturally occurring exposures in food may also qualify for exemptions when the legal criteria are satisfied.
Does third-party testing automatically eliminate the need for a warning?
No. Laboratory testing may provide useful information, but determining warning requirements can also involve product usage, exposure calculations, and regulatory assessment.
Why might two supplements have different warnings?
Differences in ingredients, sourcing, product formulations, exposure levels, manufacturing methods, and other factors can affect warning determinations.
